1. Acceptance of Terms
By accessing or using the Devanza platform (the "Service"), operated by Devura, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not access or use the Service.
These Terms apply to all users of the Service, including salon and spa owners, staff members, individual service providers, and end-user clients who book appointments through the platform. We reserve the right to update these Terms at any time. Continued use of the Service following any changes constitutes acceptance of the revised Terms.
2. Description of Service
Devanza is a software-as-a-service (SaaS) platform designed for salon, spa, and beauty business management. The Service includes, but is not limited to:
- Online appointment booking and scheduling for clients and staff
- Client relationship management (CRM) and communication tools
- Staff scheduling, performance tracking, and commission management
- Multi-branch management and centralized reporting
- Point-of-sale (POS) integration and inventory management
- Promotions, loyalty programs, and marketing automation
- Home service booking and dispatch for mobile beauty professionals
- Analytics dashboards and business intelligence reporting
- Marketplace listing for salons and service providers
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where practicable.
3. User Accounts
To use certain features of the Service, you must register for an account. When creating an account, you agree to:
- Provide accurate, current, and complete registration information
- Maintain the security of your account credentials and not share them with unauthorized parties
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities that occur under your account
We reserve the right to suspend or terminate accounts that violate these Terms, contain fraudulent information, or are used for unlawful purposes.
4. Subscription Plans
Devanza offers tiered subscription plans with varying features and capabilities. Details of each plan, including pricing, feature inclusions, and usage limits, are available on our pricing page and within the platform.
4.1 Free Trial
We may offer a free trial period for new users. At the end of the trial, your account will be converted to a paid subscription unless you cancel before the trial expires. No charges will be made during the trial period.
4.2 Plan Changes
You may upgrade or downgrade your subscription plan at any time. Upgrades take effect immediately, and you will be charged the prorated difference. Downgrades take effect at the start of your next billing cycle. Access to features exclusive to higher tiers will be removed upon downgrade.
5. Payment Terms
- All fees are quoted and payable in the currency specified at the time of subscription (USD, JOD, or AED)
- Payments are processed securely through our third-party payment providers
- Subscription fees are billed in advance on a monthly or annual basis, depending on your chosen plan
- All fees are non-refundable except as expressly stated in these Terms or required by applicable law
- We reserve the right to change pricing with at least 30 days prior notice. Existing subscribers will be notified before any price change takes effect
- Failure to pay may result in suspension or termination of your account and access to the Service
6. Cancellation
You may cancel your subscription at any time through your account settings or by contacting our support team. Upon cancellation:
- Your subscription will remain active until the end of the current billing period
- You will retain access to all features of your plan until the end of the paid period
- Your data will be retained for 90 days after cancellation, during which you may export your data or reactivate your account
- After the 90-day retention period, your data will be permanently deleted in accordance with our Privacy Policy
We may cancel or suspend your account if you breach these Terms, with or without prior notice depending on the severity of the violation.
7. Intellectual Property
The Service, including its design, features, source code, documentation, logos, and trademarks, is owned by Devura and protected by intellectual property laws. You may not:
- Copy, modify, distribute, or create derivative works based on the Service
- Reverse-engineer, decompile, or disassemble any part of the platform
- Use our trademarks, logos, or branding without prior written consent
- Remove or alter any proprietary notices or labels on the Service
You retain ownership of all content you upload to the platform, including client data, images, and business information. By uploading content, you grant Devanza a limited, non-exclusive license to use, display, and process that content solely to provide the Service.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Devanza and its affiliates, officers, directors, employees, and agents shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
- Loss of revenue, profits, data, or business opportunities
- Service interruptions, downtime, or data loss due to technical issues, cyberattacks, or force majeure events
- Actions or omissions of third-party service providers integrated with the platform
Our total aggregate liability for any claims arising from or related to the Service shall not exceed the total amount you paid to Devanza in the twelve (12) months preceding the claim.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Hashemite Kingdom of Jordan, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Amman, Jordan.
For users based in the United Arab Emirates, disputes may alternatively be resolved through the Dubai International Financial Centre (DIFC) Courts or the Abu Dhabi Global Market (ADGM) Courts, as applicable, if both parties agree in writing.
